ENTRY IN THIS CONTEST CONSTITUTES YOUR ACCEPTANCE OF THESE OFFICIAL RULES. In order to enter the Contest (defined below), you must agree to comply with these Official Rules (“Official Rules” or “Rules”). Therefore, please read these Official Rules prior to entry to ensure you understand and agree. You agree that submission of an entry in the Contest constitutes agreement to these Official Rules and by participating in the Contest, you accept these terms. You may not submit an entry to the Contest and are not eligible to receive the prizes described in these Rules unless you agree to these Rules. These Rules form a binding legal agreement between you and Google Australia Pty Ltd (“Google”) with respect to the Contest. The Contest is for residents of Australia only and shall be construed and evaluated according to the laws of the participant’s country of residence.

1. Eligibility
   1. The Contest is open to legal residents of Australia only, who are eighteen (18) years of age or older at the time of entry.
   2. Employees, directors, officers, representatives, and agents of Google, its affiliates, subsidiaries, marketing partners, and their immediate families (spouses, parents, children, and siblings) are not eligible to enter.
   3. To participate, users must have an active email account, Internet access, and a general electronic device capable of running the game.
2. Contest Period
   1. Google’s “TAP TEMPO” Game promotion (the “Contest”) begins at 12:00 am AET on September 20, 2024, and ends at 11:59 pm AET on September 22, 2024 (the “Contest Period”).
   2. Google’s “TAP TEMPO” Game itself (the “Game”) will remain available for play until 11:59 pm AET on October 14, 2024 (the “Game Availability Period”).
   3. Winners can redeem their unique discount code from 00:00 local time on September 27, 2024, to 11:59 pm AET on October 14, 2024 (the “Redemption Period”).
3. How to Enter
   1. To enter the Contest, visit “TAP TEMPO” Game digital experience via the provided link (https://taptempo.withgoogle.com/).
   2. Within the experience, you will be able to:
      1. Play the rhythm game and achieve a score.
      2. During the Contest Period, submit your email address after gameplay to enter the prize competition.
      3. (Optional) Share the TAP TEMPO game on social media.
   3. All entries must be submitted during the Contest Period. Any entries made after this time will not be eligible for prizes.
   4. You may enter the Contest as many times as you like, but you can only win one prize.
4. Game Modes and Scoring
   1. The Game offers three different modes players can select at the beginning of the Game, each with unique scoring conditions:
      1. Classic Mode: Players must complete the Game with their chosen music track. There are no bonus points or multipliers.
      2. Double Trouble: Players must complete the Game with their chosen music track with a maximum of 3 missed notes to double their final score.
      3. Triple the Fun: Players must complete the Game with their chosen music track with only 1 missed note to triple their final score.
   2. Score Submission
      1. After successfully completing a Game for the first time during the Contest Period, players are prompted to enter their email address to be able to submit their score.
      2. Subsequent game plays during the same session, on the same browser and device, will automatically record the new high score if it’s higher than the previous one, without requiring another email submission.
5. Prizes
   1. The top 50 eligible high scorers in Australia during the Contest Period will be selected to receive a 15% discount code for use on Google Store Australia during the Redemption Period (September 27, 2024 to October 14, 2024).
   2. The discount code cannot be used with guest checkout. Limit to one use per discount code. Winners can redeem their discount code by visiting store.google.com/au, adding an eligible item to their cart and enter the unique discount code during checkout to receive a 15% discount off your purchase. Discount code may be redeemed only on Google Store Australia for eligible items as allowed by applicable laws. Can be combined with other promotional offers running at the same time. It is non-transferable, and it is not valid for cash or a cash equivalent. Google reserves the right to verify eligibility of winners.
6. Winner Selection
   1. Winners will be selected from the top 50 eligible highest scores achieved in Australia during the Contest Period. In the event of a tie, the prize will be awarded to the earliest achievers of the tied score.
   2. Winners will be notified via email before September 26th, 11:59 pm AET.
   3. Winners can redeem their unique discount code during the Redemption Period (September 27, 2024, to October 14, 2024).
   4. Discount code can only be used on purchases made on Google Store Australia.
   5. Only winners will be contacted. If you do not receive an email by September 26, 2024, 11:59 pm AET, you have not won a prize.
7. General Rules
   1. Google’s decisions with respect to the application of these rules are final and binding in all respects.
   2. Google reserves the right to disqualify any entrant from the Contest if, in Google’s sole discretion, it reasonably believes that:
      1. the entrant has attempted to undermine the legitimate operation of the Contest by cheating, deception, providing false information or using unfair playing practices or annoys, abuses, threatens or harasses any other entrants, Google, or any judges; or
      2. having the entrant participate in the Contest or be awarded a prize would be contrary to applicable law, rules or guidelines.
   3. Google reserves the right to cancel, terminate or modify the Contest if it cannot be completed as planned for any reason.
8. Privacy
   1. Entrant acknowledges and agrees that Google may collect, store, share and otherwise use personally identifiable information provided during the registration process and the Contest. The following data will be collected:
      1. User full name
      2. Date and time of entry
      3. Email address (hashed)
      4. Points scored
      5. Email opt-in preference
      6. Acceptance of these T&Cs
      7. Language preference
   2. Google will use this information in accordance with its Privacy Policy.
   3. Without limiting the above, the data referred to in section 8.1, and any related performance data, will be accessible to Google, Google’s affiliates and PHQ Studios Limited, who is involved in the creation and administration of this game, for the purposes of administering the game and the Contest. Google will take reasonable measures to protect the confidentiality and security of this data.
9. Limitation of Liability
   1. Google will not be responsible for:
      1. any late, lost, misrouted, garbled or distorted or damaged transmissions or entries;
      2. telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures;
      3. any Contest disruptions, injuries, losses or damages caused by events beyond the control of Google; or
      4. any printing or typographical errors in any materials associated with the Contest.
   2. By entering the Contest, you agree that Google, its affiliates, subsidiaries, advertising and promotion agencies, and their respective officers, directors, employees, representatives, and agents (“Google Parties”) shall not be liable (whether under contract, tort (including negligence) or otherwise) for:
      1. losses that were not caused by our breach of these Rules;
      2. any loss or damage that was not, at the time the relevant contract with you was formed, a reasonably foreseeable consequence of Google breaching these Rules;
      3. losses relating to any business of yours, including loss of profits, revenues, data, opportunity or anticipated savings, or any indirect or consequential losses; or
      4. loss of data stored on the device, or inability to access data.
   3. The extent permitted by applicable law, the Google Parties’ liability will not exceed $150.
   4. Nothing in these Rules is intended to exclude or limit Google’s or any Google Party’s liability for: (i) death or personal injury; (ii) fraud; (iii) fraudulent misrepresentation; (iv) any terms which cannot be excluded or limited by law (including under the Australian Consumer Law); or (v) any liability that cannot be excluded or limited by law.
   5. If you are a consumer, nothing in this section affects your legal rights.
10. Governing Law and Dispute Resolution
    1. These Official Rules are governed by and will be construed in accordance with the laws of New South Wales, Australia Any dispute arising out of or relating to the Contest shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
